High Court Sets Aside Bushiri’s Committal Order

Criminal Review No. 5 of 2025 (Being Criminal Extradition Case No. 1137 of 2020 at CRM Court in Lilongwe)

The High Court in Lilongwe has set aside the committal order that sought to extradite Shepherd Huxley Bushiri and Mary Bushiri to the Republic of South Africa.

Delivering its review decision, the Court found several procedural and legal irregularities in the earlier ruling, including denial of the applicants’ right to be heard, improper authentication of extradition documents, reliance on hearsay evidence, and lack of analysis on key charges.

When setting aside the committal order, the Court emphasized the need to uphold constitutional guarantees of fair hearing and the right to life.
